License Agreement / Disclaimer / Liability Waiver: The El Paso-Teller County Emergency Telephone Service Authority (hereinafter called “El Paso-Teller County 9-1-1”) hereby disclaims any and all liability or responsibility for any damage, injury, loss, claim, or lawsuit arising from any error, inaccuracy, or other problem with the Geographic Information Systems (hereinafter called “GIS”) data provided to Requestor including, without limitation, responsibility for incidental, consequential or special damages. By signature below, the Requestor hereby waives, releases, and discharges El Paso-Teller County 9-1-1 from any and all liability, damages, claims, injuries, or suits arising from or in connection with the performance of or the Requestor’s use of the GIS data including, without limitation, third party claims and any claims for incidental, consequential or special damages. The GIS data is provided “as is” and El Paso-Teller County 9-1-1 expressly disclaims all warranties, expressed or implied, as to the accuracy of the GIS data and the merchantability and fitness for a particular purpose. To the extent permitted by law, the Requestor agrees to indemnify and hold harmless El Paso-Teller County 9-1-1 from any and all losses, liabilities, damages, claims, or costs, including reasonable attorney’s fees, which may arise from or in connection with the performance of or the Requestor’s use of the GIS data. The Requestor agrees that no part of the GIS data provided by El Paso-Teller County 9-1-1 may be reproduced, transmitted, or redistributed in any form or by any means, electronic or otherwise, except as expressly permitted in writing by El Paso-Teller County 9-1-1.
